The Accident Compensation Corporation (ACC) – Te Kaporeihana Āwhina Hunga Whara – is the sole provider for compulsory insurance cover for personal injury in New Zealand. In its role, ACC makes decisions about both claims for cover and levies.

If ACC makes a decision about your claim or your levy invoice that you do not agree with, you are entitled to have that dispute resolved by either:

  • a Review – this is a statutory process where an independent reviewer will reconsider ACC’s decision and determine whether or not it was correct; or
  • Mediation – this is a consensual, confidential and relatively informal negotiation process where an independent mediator will help you and ACC to reach a mutually acceptable settlement of the dispute.

Whether you wish to have the decision reviewed or your dispute with ACC mediated, ICRA is able to assist.

How do I apply for a review?

To apply for a review, you need to either write to ACC directly or simply complete a review application form.  You can find out more about the process down below.

If you choose to write to ACC rather than completing the ACC33 Review Application Form, you need to include the following in your letter:

  • your name, address and contact number;
  • the claim number, or ACC number if it’s a levy review;
  • the date of the decision ACC made that you would like reviewed;
  • why you want a review and what you would like to happen as a result of the review;
  •  whether you would like any cultural support or have accessibility needs; and
  • any supporting documents or evidence to support your review.

Your application must be made to ACC within three months of its decision being made – that date will be recorded on your decision letter or the levy invoice.

Yes. If you are applying on someone else’s behalf, you will need to also complete and include an ACC5937 Authority to Act Form with the application.

Mediation is a consensual, confidential and relatively informal negotiation process in which parties to a dispute use the services of a skilled and independent mediator to assist them to define the issues in dispute, to develop and explore settlement options, to assess the implications of settlement options and to negotiate a mutually acceptable settlement of that dispute which meets their interests and needs.

The objective of mediation is to enable and empower the parties to negotiate and resolve the dispute promptly, cost effectively and confidentially rather than to have a decision imposed upon them by a judge, arbitrator or adjudicator. The process enables the parties to negotiate flexible and creative solutions which need not conform to strict legal rights or general community standards.

Ultimately, mediation puts the power back in the hands of the parties to the dispute.

Even if mediation is not successful – ie you are not able to reach an agreement – this does not affect your right to apply for a formal review of the decision in question.

You can initiate mediation by clicking below to request ICRA to appoint an independent mediator to help you to resolve your concerns with ACC.

After we receive your request, we will contact ACC and invite them to join the mediation process.
