Apply for the ACC Review process

If you disagree with a decision that ACC has made on your claim, levies, or under the Code of ACC Claimant’s Rights, you are entitled to apply for a review of that decision.

Process Overview

ICRA is dedicated to providing fair, simple, speedy and efficient resolution processes from start to finish. Find out more about our process for ACC reviews below.

1. Starting the process

Start the process by submitting an application to ACC.

2. Discuss with a case manager

A case manager will contact you to explain the review process, address any questions you may have, and facilitate arrangements on your behalf.

3. Case conference

A case conference will be scheduled and conducted with the reviewer assigned to your application.

4. Preparation for the review

Prepare for your review by outlining the reasons you believe the decision made by ACC is incorrect.

5. Review hearing

A hearing will be held between you and the reviewer to discuss your submission to ACC in detail.

6. Decision

A decision will be made and issued within 28 days following the hearing.

Step 1. Starting the process

To initiate the process, you need to submit an application to ACC and request an independent review by ICRA. This application must be made within three months of ACC’s initial decision.

Under the Act, if the matter cannot be resolved directly with you, ACC is obligated to arrange for an independent reviewer to handle your case. Once we receive your details from ACC, we will schedule a time for your case conference.

Step 2. Discuss with a case manager

A case manager will reach out to you to explain the review process, answer any questions, and make arrangements on your behalf. During this stage, you can inform them if you have any disability, cultural, or language requirements, and we will ensure these are accommodated during the selection process.

When selecting a reviewer, ICRA takes into account various factors, including the individuals involved, the nature and value of the review, and the reviewer’s availability to manage the case effectively and efficiently.

Step 3. Case conference

A case conference is arranged and held with the reviewer who will be handling your application. It is essential to come prepared, as the purpose of the conference is to help clarify the issues, agree on the next steps, and confirm timelines. At this stage, the reviewer may suggest mediation as an alternative to the formal review process.

Step 4. Preparation for the review

In preparation for the review, we encourage you to gather and organise information to support your claim. Please provide copies of any evidence, relevant medical reports, and a written submission explaining why you believe ACC’s decision is incorrect.

You can download the form below and use it to write your submissions. The form also includes helpful suggestions about what information to include:

Step 5. Review hearing

After all relevant documents have been exchanged, a hearing will be scheduled. The hearing can take place either online or in person. This gives the reviewer an opportunity to ask questions of both you and ACC to gain a clearer understanding of your positions. The reviewer may also ask you to elaborate on your submission.

Step 6. Decision

The reviewer will issue a written decision within 28 days of the hearing. The decision may either uphold or overturn ACC’s original decision, or the reviewer may direct ACC to reconsider your case. While the reviewer’s decision is binding, both you and ACC have the right to appeal the decision to the District Court.
